About this course:
The enforcement process includes a statutory process for disputing the issue of a Penalty Charge Notice (PCN) but the Transport Management Act (TMA) also requires Councils to consider informal challenges received before the issue of the Notice to Owner (NTO). The Operational Guidance places an emphasis on the Council’s duty to act fairly and reasonably to aid the transparency of the parking operation. Those dealing with the responses to challenges need to understand the importance of the responses in the process and the influence they have on public perception. This course is designed to provide delegates with an understanding of the role of correspondence within the enforcement process and the evidence and areas they should consider when responding to challenges.
Learning outcome:
At the end of this course delegates will understand the role of enquiries in the PCN enforcement process. They will be aware of the types of enquiries which might be received, the basic evidence requirements to support a valid PCN and items to consider when deciding if a PCN should be upheld. They will also discuss and consider the purpose of any responses which are issued.
Suitable for:
N.B. Delegates must have either completed the Parking Legislation and PCN Progression course or have an understanding of the contravention codes.
